1. About DesireHub and these terms
These Terms and Conditions (“Terms”) apply to the website, private consultations, proposals and services supplied by DesireHub Travel LP (“DesireHub”, “we”, “us” or “our”).
Registered name: DesireHub Travel LP
Company number: [COMPANY NUMBER]
Registered office: [REGISTERED OFFICE, UNITED KINGDOM]
Email: info@desirehub.org
Website: www.desirehub.org
“Client” and “you” mean the adult making an enquiry or entering a contract with us. If you arrange services for another adult, you confirm you have authority to provide their information and accept obligations on their behalf, but each traveller may also be required to accept relevant terms personally.
2. Eligibility
You must be at least 18, have legal capacity to contract, provide accurate information and be legally permitted to receive the requested services in the relevant places. We may require age, identity, payment, sanctions, fraud or travel verification before accepting or continuing an enquiry.
We may decline an enquiry at our discretion before contract formation, particularly where a request appears unlawful, unsafe, exploitative, abusive, misleading or inconsistent with our standards.
3. Our role and service descriptions
Depending on the written proposal, DesireHub may act as:
- a principal supplying its own consultancy or concierge services;
- an organiser of a legally compliant package;
- a disclosed agent for an identified travel organiser, airline, accommodation provider or other supplier; or
- an introducer or coordinator where the client contracts directly with an independent supplier.
The final proposal or confirmation will identify the relevant role where it affects your rights. Independent suppliers control their own services, rules, availability and decisions. Their terms may apply in addition to these Terms.
Website descriptions, example itineraries, “approximately €4,000” references, images and informal discussions are illustrative. They are not guarantees or binding offers. Inclusions, exclusions, duration, destination, standard, price and supplier identity are those stated in the final written proposal and confirmation.
4. Flights, packages and travel protection
A combination of flights, accommodation, passenger transport or other travel services may constitute a package or linked travel arrangement under mandatory law, regardless of the label used by the parties. Where those rules apply, they prevail over inconsistent provisions in these Terms.
DesireHub will only arrange or accept payment for flight-inclusive travel where it is legally authorised. Before payment, the client will be told whether:
- the flight-inclusive arrangement is protected by an identified ATOL holder, with the relevant ATOL number and certificate process;
- DesireHub acts as an authorised agent for an identified organiser;
- the client contracts and pays directly with an airline or licensed travel provider; or
- another lawful structure or exemption applies.
ATOL/organiser details: [INSERT ATOL HOLDER, ATOL NUMBER AND AGENCY STATUS, OR STATE THAT CLIENTS BOOK AND PAY FOR FLIGHTS DIRECTLY]. Do not rely on this page until those details are verified.
Where a package-travel regime applies, required pre-contract information, responsibility for performance, insolvency protection, cancellation rights, price-change limits, assistance and refund obligations will be provided and honoured as required by law.
5. Enquiries, proposals and contract formation
- Submitting a form or message starts an enquiry only.
- We may request clarification, verification and supplier availability.
- We issue a written proposal showing the proposed services, material exclusions, price, payment schedule, supplier terms and validity period.
- You must review and accept the proposal within its validity period.
- A contract forms only when we issue written confirmation after receiving the required cleared payment and confirming relevant availability, unless mandatory law provides otherwise.
No employee, advisor or messaging conversation may promise a service, individual, outcome, refund or variation unless confirmed through authorised written confirmation.
6. Prices, additional costs and payment
Prices may vary according to departure point, destination, dates, exchange rates, taxes, flight fares, baggage, accommodation, room type, transport, itinerary, supplier availability, requested comfort and custom services. The proposal will state the currency and whether taxes or compulsory charges are included.
Unless expressly included, you remain responsible for visas, insurance, vaccinations, personal purchases, minibar, damage, tips, optional activities, extra guests, additional drinks or meals, excess baggage, unscheduled transport, upgrades, overtime and costs caused by your acts, omissions, delay or non-compliance.
Payment may be agreed by bank transfer, Wise or Revolut. You must use only payment instructions sent through an authenticated DesireHub channel, pay from a lawful source in the agreed currency and bear your bank or conversion charges unless stated otherwise. We may reject third-party, anonymous, reversed, disputed or suspicious payments and request proof of payer identity.
Deposits, balance dates and whether particular amounts are refundable will be stated in the proposal. Late payment may cause availability to lapse, price changes or cancellation. Title to funds does not compel us or any individual to perform an unlawful, unavailable or non-consensual service.
7. Client verification and anti-fraud protections
We may conduct proportionate identity, sanctions, fraud, safeguarding and source-of-funds checks, and may pause or refuse a transaction pending satisfactory information. Providing false documents, impersonating another person, attempting chargeback abuse or using unlawfully obtained funds is a material breach. We may retain or disclose relevant records where reasonably necessary to prevent crime, protect a person, respond to a bank or comply with law.
8. Adult companionship and nightlife arrangements
Where lawful in the destination, DesireHub may coordinate or introduce adult companionship, nightlife, massage or related adult lifestyle enquiries. The exact role, supplier and included arrangements will be stated privately. DesireHub does not own or control an independent adult’s body, decisions or consent and does not guarantee any sexual, intimate or personal activity.
- Every participant must be an adult and act voluntarily.
- Consent must be specific, informed and ongoing and may be withheld or withdrawn at any time.
- Payment never purchases consent and never creates a right to a particular act or outcome.
- A preference request does not guarantee a particular person.
- An independent companion may decline, change or end an arrangement.
- No underage, forced, coerced, trafficked, exploitative, abusive, non-consensual or unlawful request is accepted.
- No unapproved recording, photography, disclosure of identity or invasion of privacy is permitted.
If an option becomes unavailable, we may offer a suitable alternative where possible. Any refund or credit is governed by the confirmed contractual structure, mandatory law, services already supplied and recoverable third-party amounts.
9. Your responsibilities
You are responsible for:
- valid passports, visas, entry permissions, insurance, health requirements and compliance with airline, hotel, venue and destination rules;
- checking official travel advice and obtaining appropriate medical or legal advice;
- arriving on time, remaining contactable and promptly reporting changes;
- treating employees, companions, suppliers, drivers, hotel teams and venue staff respectfully;
- reasonable control of alcohol or other lawful substances and avoiding dangerous or disruptive conduct;
- your personal property, decisions and expenses;
- loss, damage, fines or costs caused by your breach, negligence or misconduct, to the extent permitted by law.
We strongly recommend comprehensive travel insurance covering cancellation, curtailment, medical care, repatriation, baggage and activities. Failure to obtain insurance does not transfer insured risks to DesireHub.
10. Supplier rules and destination risk
Airlines, hotels, banks, venues, transport operators and other suppliers may impose identification, check-in, visitor, dress, behaviour, cancellation and security rules. Their operational decisions may be outside our control. You must comply with lawful rules and must not assume that a hotel or venue permits a visitor or activity merely because it was requested.
Travel involves inherent risks, including illness, crime, weather, disruption and legal or cultural differences. We provide coordination, not legal, medical, immigration, financial or security advice. Nothing in these Terms makes you waive liability that the law places on us.
11. Changes, cancellation and refunds
Changes requested by you
Changes are subject to availability, supplier approval and revised pricing. You must pay any fare difference, supplier fee and reasonable administration cost disclosed before the change is made.
Cancellation by you
Notify us in writing. The cancellation becomes effective when received. Charges will reflect the confirmed terms, timing, work already performed, non-refundable or unrecoverable supplier costs and applicable mandatory law. A supplier’s refusal to refund may affect the recoverable amount, but does not remove statutory rights or obligations that legally apply to us.
Changes or cancellation by us
We may make minor reasonable changes and will communicate material changes. We may cancel or suspend where payment is overdue, verification fails, performance becomes unlawful or unsafe, a supplier withdraws, minimum requirements are not met, or you materially breach these Terms. Mandatory package-travel remedies remain unaffected.
Conduct-related termination
We may immediately suspend assistance or an adult lifestyle arrangement for threats, harassment, violence, discrimination, coercion, illegal requests, serious intoxication, unsafe behaviour, unauthorised recording or disregard for consent. You may remain responsible for used and non-refundable services and reasonable loss caused by breach, subject to mandatory law.
Unavoidable and extraordinary circumstances
Events beyond reasonable control may include severe weather, natural disaster, epidemic, war, civil unrest, government action, border closure, supplier failure, transport disruption, cyber incident or utility failure. Rights and responsibilities will depend on the contract and mandatory law; this clause does not remove statutory package-travel rights.
Refund method and timing
Any approved refund is normally made to the original payer through a reasonably available method, after required verification. Timing may depend on banks and suppliers, except where law imposes a specific deadline. We may deduct only amounts lawfully chargeable and will explain the calculation.
12. Complaints and assistance
Report problems promptly while they can still be addressed, using the official contact details in your confirmation. Give a clear description and reasonable opportunity to investigate. For urgent threats to health or safety, contact local emergency services first. After travel, send a written complaint to info@desirehub.org with relevant evidence.
13. Liability
Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights, or any liability that cannot legally be excluded or limited.
Where permitted by law and subject to mandatory travel protections:
- we are responsible only for loss that is a reasonably foreseeable result of our breach;
- we are not liable for business loss where you contract as a consumer, including loss of profit, revenue, opportunity or business interruption;
- we are not liable for a failure caused solely by you, an unconnected third party that could not reasonably have been foreseen or avoided, or unavoidable extraordinary circumstances, except where law provides otherwise;
- any compensation may take account of sums received from airlines, insurers, banks or other parties so that there is no double recovery;
- for services outside mandatory package-travel liability, our aggregate contractual liability is limited to the amount paid to DesireHub for the affected service, unless a higher limit is required by law.
Nothing makes DesireHub liable for an independent adult’s personal choice to withhold or withdraw consent. This does not excuse our own negligence, breach of duty or statutory responsibility.
14. Indemnity for unlawful or commercial use
If you use the service for business, resale, unlawful activity or without authority, you will reimburse reasonable losses, claims and costs directly caused by that breach, to the extent enforceable by law. This clause does not apply to ordinary consumer use or remove consumer rights.
15. Website use and intellectual property
Website content is general information and may change. You may not copy, scrape, resell, impersonate, reverse engineer, introduce malware, interfere with security or use content to exploit, identify or harass any person. DesireHub names, designs, text and graphics are protected by applicable intellectual-property rights.
16. Privacy and communications
Our Privacy Notice explains personal-data use and our Cookie Policy explains device technologies. Electronic messages and written confirmations may be used as contract records. You must protect access to your email, device and messaging accounts and notify us promptly of suspected compromise.
17. Transfer, third-party rights and entire agreement
You may not transfer a booking without written approval and supplier agreement. We may transfer our rights or obligations where your protections are not reduced and law permits. Except for a supplier expressly given enforceable rights, no third party may enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
The final proposal, confirmation, these Terms and incorporated supplier terms form the agreement. Nothing excludes liability for fraud. If a provision is invalid, the remainder continues. Delay in enforcement is not a waiver. Headings are for convenience.
18. Governing law and jurisdiction
These Terms and non-contractual disputes are governed by the law of England and Wales. If you are a consumer resident elsewhere, you may retain mandatory protections and rights to bring proceedings in another competent court that cannot lawfully be displaced. Subject to those rights, the courts of England and Wales have jurisdiction.
19. Changes to these Terms
The Terms in force when a contract is formed normally govern that contract, unless a lawful written variation is agreed or mandatory law requires otherwise. We may update website Terms for future enquiries and will display the effective date.
